“You have to ask yourself if you believe in the Separation of powers in the Constitution or not. It is very simple. Yes or No.”

    Yes.

Do you believe in Rich’s characterization of the Constitution and what the separation of powers means?

    No.

Let’s just think about that for a minute. We already know that Congressmen spend around 60% of their time – that’s MORE THAN HALF of their time FUND RAISING for their next term.

Now add to that the fact that all the GOP House members are wasting time on this fool’s errand for the FIFTIETH time. Could one make a case for at least negligence of their oath of office, if not outright opposition to it?

Cui bono? Who benefits? The answer is nobody. It’s only about inflicting pain on anyone and everyone who isn’t as crazy as them.

And I’ll ask the question again for the umpteenth time here on this blog that has NEVER actually been answered by my friends on the other side:

You’ve had over 30yrs. of prevailing economic/political sway in this country. Your core ideology has been baked into the cake for over a generation. Are Americans better off because of it? And if you dare to answer yes to this question, please provide some facts supporting your position for us. If no, why do you still support this vision?

Well, look what SCOTUS did to POTUS. More on the way I bet.

The denials from the Executive Branch are getting more shrill.

The President violated the Separation of Powers. The President or any President should not use Executive Orders to go around the other branches of government.

    Guilty.

I gotta’ give you credit, Rich, you don’t play favorites. I’m going to pull a quote from one of your posts back when Bush II was president and we were having intense discussions about the “Imperial Presidency” he had invoked…

    …hang on…

    …I know they’re here somewhere…

    …looking…

    …looking…

    …I stand corrected.

if you read past the sensational headline, you’ll realize the headline is misleading at best, inaccurate at worst. What the ruling did was clarify the definition of when Congress is officially in recess when it is holding pro forma meetings to appear it is still in session:

‘Justice Stephen Breyer said in his majority opinion that a congressional break has to last at least 10 days to be considered a recess under the Constitution.’

‘Still, the outcome was the least significant loss possible for the administration. The justices, by a 5-4 vote, rejected a sweeping lower court ruling against the administration that would have made it virtually impossible for any future president to make recess appointments.

‘The lower court held that the only recess recognized by the Constitution is the once-a-year break between sessions of Congress. It also said that only vacancies that arise in that recess could be filled. So the high court has left open the possibility that a president, with a compliant Congress, could make recess appointments in the future.’

(from link posted by HMC Rich)

I wonder how many of Bush43’s 171 recess appointments (compared to Obama’s 32 so far) would be illegal under this definition?

“The President or any President should not use Executive Orders to go around the other branches of government.”

The story and the ruling clearly have nothing to do with executive orders (recess appts are a different thing). Actually reading the story you posted should clarify things a bit.

yep, reading all and comprehending is very important…

now . one more time, about those “executive orders:

Fair enough Dobro, but the fact remains he violated the rules of this government and he has stated he will use his pen to “do something” which means using executive orders to get around laws he doesn;’t like. Harry Reid should at least bring some bills from the House up for a vote but he won’t.

I have read many of the Executive Orders and plenty are agreeable and do not circumvent the process.

As far as I can tell he feels no need to follow the rules of the Constitution which he took an oath to do. I don’t any President to go beyond their set of powers regardless of political affiliation.

You will see more decisions overturned. 2017 can’t get here quick enough.

Metrognome, good question. If they were true recess appointments it would not have been an issue. If Bush II did the same it would have been wrong.

Yes, I lean right (maybe even bend far right at times) but if there is a law it needs to be followed. If it is a bad law, then get rid of it or amend it.

Considering the sickening deterioration of following laws in society it should be expected that politicians using our tax dollars follow the laws that they and their predecessors make.

That is why immigration is a such a failure for both sides of the aisle. There are plenty of laws on the books but they are not being followed.

Yes,I agree. President Hillary Clinton is going to have plenty of work to do, cleaning up after 8 years of Republican obstructionism. With luck, she’ll have a Dem congress to help her!

“…but the fact remains he violated the rules of this government”

Please give at least one example of Obama violating any laws.

    Hmcrich’..

The test for whether congress is in session is supposed to be whether there are enough members present to get work done

The supreme court may think having one person show up meets that criteria

    But I don’t.

If you are honest….Neither do you

The law is the law whether you want to follow it or not. And that is the problem with this imperial president and the coward that is in charge of the DOJ. HOLDER MUST RESIGN. We need some integrity.

How about a few more examples from the most transparent administration EVER!!!! Why here are ten from just last year.

President Obama said he would fundamentally change America. And he is by trashing the Constitution. He acts like a spoiled child. He is an embarrassment and has hurt our future with his admins lying, over spending, and horrible foreign policy decisions. This admin is the worst so far and he had some ground to cover after Bush. Unfortunately he is even worse.

But you guys are so blinded by ideology that you almost seem to applaud his actions.

I was against the Patriot Act. I knew the government would over react after 9-11.

Many of you made jokes about Bush being an idiot, but why is it, this guy finds out from the press what his government and his agencies are not doing right???

You told me what Bush did wrong. Now tell me what Obama has done wrong. If you cannot name one thing then you belong in his cabinet. (And I didn’t even talk about … here it comes Jan and Mike…. Benghazi)

    HMCRich..

i am not the least bit blinded by ideology…

Obama has done plenty that i don’t agree with and i post about those lapses far more often than you choose to acknowledge.

and i still don’t think that justifies nit picking rules and typological errors to hamstring a president.

neither would you if you weren’t blinded by your own ideology.

One really has to ask who the spoiled children are here when the nation’s business can’t get done because of those in Congress who are too busy trying to thwart the president to get any work done.

Interesting. All those links, and still not one example of Obama breaking a law. Opinions about constitutionality of some acts (all yet to be considered by SCOTUS), partisan rumors about former employees and irrelevant stuff about media creatures, but still not ONE example of Obama breaking a law. Pretty weak sauce.

Hey, maybe Obama should have hired John Yoo to write an executive opinion paper to create a new class of citizen – you know, like “enemy combatants”?

And interestingly enough, a defining element of said special class is that they’re automatically covered by Medicare.

You know, all extra legal and stuff.

Oh, and that special class would (coincidentally) include EVERY FRICKIN’ AMERICAN citizen.

Just off the top of my head, I disagree strongly with his continuation of Bush policies regarding drone warfare, NSA spying and the FISA court.

“This admin is the worst so far…”

    Demonstrably untrue.

I strongly suspect that ANY President, from either party – or even a third party, simply gets overridden on lots of issues that deal with the Military and Security Industrial Complexes. (Eisenhower’s nightmare is fully realized.)

Those entities are so entrenched with their way of doing business that almost anything they want to do, they do, sanctioned or otherwise. Sure, they’re happy to make their case to the powers that be but if they get turned down, they take the op into the background and maintain plausible deniability for the electeds.

Example #1: Total Information Awareness. Adm. Poindexter got it funded for some limited operation. Dem Senate defunded it and told him to shut it down. Gee, what do you think happened? It metasticized into what Snowden exposed and we all should/did expect. We live in a lockdown information security state.

What’s legal? Who knows? What’s effective? Trust us, we’ll tell you. What’s moral? Don’t be childish. Morals are for peace time…and we don’t plan on having any of that again. There’s no money in it.

this just about says it for me

“”I would say my main criticism of Barack Obama is that he seemed to think when he came in, and in the ensuing years, that he could negotiate with right-wing extremists who really had no intention of ever negotiating.”
