19-year-old Skyelar Hailey, arrested after a foot chase in Admiral this past Tuesday (first story here, followup here), is now charged with two counts of residential burglary – the first one involving the West Seattle High School purse theft in the original report, second one involving a home nearby. The King County Prosecuting Attorney’s Office filed the charges today and is requesting that bail for Hailey remain set at $25,000 because: “The defendant has a prior conviction for Criminal Trespass in the First Degree (2008) as an adult and juvenile adjudications for Theft in the First Degree (2008); Theft in the Second Degree (2008); and Harassment (2007, 2007). The defendant is only nineteen years old and has five misdemeanor or felony resolutions in the past two years. The defendant is likely to fail to appear in response to a summons.” We also have the documents detailing the case against him; we are not uploading the documents themselves because they include victims/witnesses’ names, as well as that of a juvenile who so far is not charged in the case, but we have cut-and-pasted the “probable cause” text (with omissions noted either parenthetically or with ellipses). On 08/18/09 at about 0735hrs (victim #1) who is a teacher with the Seattle School District entered West Seattle High School located at 3000 California Ave SW. The school is equipped with video surveillance cameras. The school is closed for the summer and the only people allowed inside the school at the time were administration (and) staff. (Victim #1) went into the cafeteria area and placed her purse on a table.

Her purse contained 6 Visa credit and debit access cards, car keys and several other belongings. Approximately 1 minute later Hailey and (17-year-old girl) entered the school through the closed north front doors. Neither Hailey nor (girl) is enrolled in the Seattle Public School district and neither one of them had a legal reason to be in the school.

Surveillance videos captured Hailey and (girl) coming in the front door together and walking into the Cafeteria area. Hailey is clearing wearing a San Diego football jersey (#21), long denim jeans, and a black ball cap. (girl) is wearing short denim shorts and a white pull over sweatshirt. Video shows Hailey and (girl) walk over to a table, which has (victim #1)’s purse on it. Hailey grabs the purse while (girl) watches him and Hailey puts the purse inside his pants. The two of them walk out of the school together.

(name) who is a school employee is in the cafeteria at the same time and sees Hailey and (girl) milling around the table where (victim) placed her purse. There is nobody else in the cafeteria. (Employee) didn’t witness the theft but watçhed Hailey and (girl) exit the building. A few minutes later (victim #1) enters the cafeteria and discovers her purse is gone and tells (employee). (Employee) tells her what he saw.

Hailey and (girl) leave the school and walk to (person #1)’s house located at (3200 block Walnut), which is 2 blocks from the schooL. They meet (person #1) in the rear building of the residence. This building is detached from the house and is where (person #1) sleeps.

At about 0830hrs (victim #2) enters the rear building because he has to take (person #1) to an appointment at 0900hrs. (Victim #2) knows Hailey and (girl) because they are friends with his son and he has allowed them to stay in the rear building for weeks at a time. When (victim #2) enters the building he observes Hailey and (girl) going through property, including credit cards, which appeared to come out of a brown purse, which was next to them. (Victim #2) noticed the name on one of the cards was (victim #1). (Victim #2) told (girl) and Hailey to leave and he took his son to the appointment. At about 0855hrs (victim #2) drove off and watched as Hailey and (girl) walked away from his residence. …

(Victim #2) returned home at about 0930hrs and discovered that while he was gone his house was burglarized and a separate dwellng upstairs that is rented to (victim #3) was also burglarized. There was no forced entry.

Because (victim #1) had her car keys stolen she called her daughter … so her daughter could bring a second set of keys to the school. (victim #1) told her daughter what happened including a brief description of the suspects. At about 1020hrs (victim #1’s daughter) arrived at the school and noticed Hailey and (girl) loitering in the parking lot of the school. (Victim #1’s daughter) notified her mother and (victim #1) phoned 911 and watched Hailey and (girl) continue to loiter around the school.

At about 1021hrs Officer Nelson and Officer Freutel arrive and see Hailey and (girl) in the area of the school. Offcer Freutel took (girl) into custody but when Officer Nelson went to contact Hailey and ordered him not to run, he ran. Officer Nelson could see that Hailey was holding a black bag in his hand.

Officer Nelson chased Hailey for several blocks and got face to face with him in the yard of (a house in 2600 block of 41st SW). Hailey dropped the black bag on the ground and ran. Officer Jorgensen located Hailey (in the same block).

Hailey had stripped his hat, sunglasses and football jersey. The items were located inside and outside a
recycle bin about 10 ft from where Hailey was arrested. These clothing items matched the clothing Hailey was wearing when he was in the schooL Offcer Nelson returned and recovered the black PCC bag that Hailey was seen carrying. The bag contained DVD’s, CD’s, a Vaio power cord, and a black leather fanny pack. These items Were stolen from (victim #2)’s and (victim #3)’s residence. Inside the fanny pack was (victim #1)’s T-Mobile cell phone, Ipod Nano, Seattle Metropolitian credit/debit cards, School employee Visa card and gift cards which all belong to (victim #1). Also inside the fanny pack was a prescription bottle of Benezepril. HCTZ in (victim #3’s) name. Whle searching Hailey incident to arrest Officer Dela Cruz found a small glass container containing a white powder, and several white pills in a Ziploc bag. These items were in Hailey’s front right pocket.

When Officer Preutel arrested (girl) she was caring a large Coach leather purse which contained (victim #1)’s Wa Driver’s license, a digital camera, a palm pilot and two pairs of sunglasses which all belonged to (victim #1). There was also a Sony Vaio laptop computer in the purse, which belonged to (victim #2). (Employee) who was the only other person in the cafeteria when the purse was stolen positively identified (girl) and Hailey as the same two people that he saw milling around in the cafeteria near (victim #1)’s purse.

Hailey and (girl) were transported to the Southwest Precinct and agreed to an audio and video-taped interview. After being read his Constitutional rights and agreeing to the interview on tape Hailey admitted to going into the school and stealing the purse. Hailey denied being involved in (victim #2) and (victim #3)’s burglary and couldn’t explain how he came in possession of items stolen from inside the two residences.

After being read her Constitutional rights on tape (girl) admitted to going into the school with Hailey but she claims she didn’t know Hailey was going to steal anything. (Girl) also stated that after (person #1) and (victim #2) left their house, she and Hailey went back to the residence. She watched as Hailey tried to enter the rear door of the residence but the door was locked. She then watched as Hailey climbed through the doggie door and entered the residence. (Girl) said she stood beside the house while Hailey was inside and after being inside Hailey came outside with a laptop and several other items from inside the home.

Prosecuting Attorney’s Office spokesperson Dan Donohoe tells us a decision is still being made about what if any charges the 17-year-old girl with Hailey will face (we should know that before the end of the day). Meantime, his arraignment — at which he will enter a plea to these charges — is scheduled for September 3rd.
