Alki burglary/package-theft suspect, caught in a treehouse, now charged with 3 felonies

Following up on last Thursday’s Alki arrest – in which, as reported in our first followup, the suspect was found in a treehouse: 32-year-old Emanuel Kozma is now charged with three felonies, 2nd degree burglary, 1st degree criminal trespass, and 3rd-degree theft. Our first report included a reader report that Kozma was also suspected in a package theft earlier in the day, before the Alki search and arrest resulting from a package theft inside a secure building, and the charging documents include the earlier incident. An excerpt:

… The defendant entered a secure apartment building lobby and stole a package delivered for a tenant. When confronted by a witness, the defendant dropped the items he had taken out of the stolen package and ran away.

When police found the defendant and inventoried his bag, they discovered items stolen from the front porches of a nearby duplex as well as assorted checks not written to the defendant. The residents of the duplex had surveillance video of the defendant stealing delivered packages.

The defendant has had 23 warrants since 2001, based on 30 bookings at King County Jail. At the time of his arrest, the defendant had an outstanding DOC Escape warrant related to his Assault 3 conviction and community custody. The defendant fled when confronted by a witness and hid from police in a tree; he finally came down when a police K9 officer indicated he was in the tree. Also, the defendant has two convictions for Attempting to Elude. Additionally, the defendant’s references were not available to verify his address, employment, or ties to the community. The defendant is facing a significant prison sentence if convicted as charged – his standard range for Burglary 2º is 51 to 68 months. For all of these reasons, the State believes the defendant is a flight risk if released.

The apartment-building theft happened in the 6000 block of SW Stevens; the earlier thefts, in the 2400 block of 55th SW. Meantime, the King County Jail Register indicates Kozma remains in jail, with no bail amount set so far, as stipulated in the aforementioned warrant for escape. We’re checking with the state Corrections Department to see if a photo of him is available to add to this story.     Something is wrong with our system when a person has failed on too many “second chances” and is still out of jail. It seems that we need to increase the consequences for that type of behavior.

    amazingly brazen guy who should have been off the streets a long time ago. Would be interesting to know how he got into a “secure” building.

      I don’t know if police know that so far – the narrative picks up, in both versions I have read (for the followup last week in the probable-cause documents, and then the charging documents this week), with a resident of the SW Stevens building confronting him because he saw Kozma in the lobby and knew he wasn’t someone who lived in the building. As mentioned in the previous followup, that resident is who called 911 while following Kozma (in his truck, not on foot). After I get past another pressing (but unrelated) story, I’m going to look a bit further into his history – since his last known address is White Center, I’d imagine some of his past convictions might involve WS crimes. – TR

    Something is definately wrong with our judicial system when someone like this is booked 30 times since 2001 and out on “community custody”.
    Instead of the current “book and release” methodology, why not 68 months of community service-hard labor. Maybe teach him a skill or trade while doing time instead of being released and continuing on as a menace to society.

      “Community custody” is the Washington term for “probation,” as in, after the stipulated prison sentence (with potential time off for “good behavior,” time credited for what’s been served in jail while awaiting trial or plea, etc.) has expired.

    He doesn’t seem to be a very good thief, he keeps getting caught- hard labor community service that does teach him a skill would be a great gift (if he’d use it)

    I we could know what he’s thinking, why he thinks this is okay and is it really easier than honest work?

      Sparkles – it’s the same old story. Substance abuse. While that’s not mentioned in this case, I found it in an older case that I looked up last week to try to figure out which of several burglary suspects on the jail register was the Alki suspect (as you’ve probably seen me gripe before, we do NOT get names even when we get the report narratives – suspects are redacted as well as victims – otherwise I would be following MANY more of the cases on which we report) – a case that involved an assault in White Center a couple years ago; if you find a case filed against someone in the court system, you can usually find an original police report with their address as well as age info, and based on the age, description, and address on Kozma, I guessed he was more likely to be the Alki suspect than the other two people booked into KCJ in the same timeframe for burglary charges, and when I fished with the Prosecuting Attorney’s Office the next day, it turned out I was right. ANYWAY, that particular set of court documents mentioned that he had admitted substance-abuse problems, which seem to be at the root of a huge number of these repeat theft/burglary suspects’ situations. Not that it’s an excuse, but it means they “need” money, and since addiction likely gets in the way of a real job, this is what they do … TR

    BRAVO to the resident who was relentless in this case, I a curious though when I look at the photo, the picture shows long hair coming out of the back of a cap, was he wearing a wig, his hair does not look that long. I hope this looser is locked up for a very very long time. Cant we just put them all on a barge and anchore it in the middle of Alaskan waters some where!!

      Joeanon – If you read the excerpt from the court docs, this time he faces at least 4 years in prison. Which might not sound like much, but in comparison to cases like this that we’ve covered in recent years, it’s significant, for a non-violent crime. We’ll be watching and following up.

      Whenever we can, once somebody is charged, we’ll show their photo – but as I’ve noted before, a photo isn’t always available, unless they’ve served time in the state prison system, which was the case here, so I e-mailed the state DOC, and they turned it around quickly. For example, the previous charges-filed case we reported this week, High Point stabbing suspect Beverlee Darden, there’s no photo available – she has a record but did not serve time in state prison. Since many cases go to plea bargains, and it’s difficult to get imagery at arraignments, otherwise we often don’t get a photo until and unless we can cover the sentencing, so at least we have that for future reference if and when they get out … TR

    He probably doesn’t mind going back as he can get a good medical check up and care, dental work if needed, have a warm bed and cable tv along with internet. See a few friends learn the latest scams. Probably serve less than 4yrs and get a severance package when he is released to cover housing and medical so he’s healthy to continue his lifestyle of crime.

    These package thieves must be very stupid or very desperate or both (scary combination) to think they’ll find anything they can use or sell. Like the one who took a package containing a personalized Christmas ornament from my sister’s porch.

    You know what all you people out there can point you finger and say what ever you want but you don’t know this man like I do. Yes he may have broken the law by what he did and I am not trying to justify or condone any of his actions but if knew him like I do you would know that he loves his friends and family and would do anything for them. This man is also great with my kids and I would let him babysit them before I ever thought about anyone else. He is so good with them it makes my day when he comes to my house just to hang out with my two daughters. OK so he may have a few problems he might need help with but he is no different than any of out there that are judging him. Everyone has problems no one is perfect. I love this man and consider him a brother so until you know him all you judgmental people can keep your comments to yourself
