    Scenario:

    We have a residential construction site on our street. They have a pile of pieces of wood on the site outside of the public right of way (sidewalk, planting strip). There is no clear sign that the pile is garbage or whether the builder is going to recycle them within the property for trim,etc or just dump it.

    Random folks have been pulling up, walking on to the property and helping themselves to various pieces of wood from this pile; stuffing their trunks and truck-beds and driving off.

    is this:

    a) Plain and simple theft?

    b) Public recycling of presumed garbage off private property?

    c) ?

    dunno. pretty sure you need a permit to store anything in the planting strip.

    but if the owner/builder doesn’t know or believe that most people seem to feel entitled to help themselves to anything left there, then he/ she is naive, and probably won’t be in business for too much longer.

    but most likely they’re trying to avoid dump fees – or paying for and permitting a dumpster – by letting the vultures do the work.

    @redblack: The stuff is on the property. It is not on the sidewalk / planting strip.

    And, yes, there is no dumpster. Hmm.

    If it’s on the property, I’d call it theft. This is a problem at construction sites. Some dirtbag who used to live down my alley raided construction sites for a living. He’s now doing time.

    The property line thing can be confusing. Someone told me not long ago that they felt they were within their rights to haul away my rockery, or any other ornament, like a planter, that protrudes onto public property. So…does that mean I can take your car? Your mailbox? It’s kind of a gray area.

    Personally, I’m hesitant to take anything that doesn’t have a “free” sign on it. The simplest approach in this case would be to stop by during construction hours and just ask someone.

    either that or they posted it on CL or somewhere and people have permission…

    the only way to know is to ask though
