    i purposefully opened this thread to talk about the issues around the primary and about the issue of the primary itself…

    if this thread becomes another opportunity for those who want to carry on the divisiveness of this primary… i will stop posting.

    one of the things overlooked in the barely mentioned Clinton position…

    on the mortgage crisis… her truth in lending bill which would have required full disclosure of all mortgage terms for a valid mortgage…

    in case some of you don’t know how that works.. in most instances.. if the lending institution can not prove full disclosure.. they get to pay off the mortgage and the homeowner gets to keep the house.., free and clear.

    sort of keeps everybody honest:)

    Can anyone explain to me why when i put Clinton camaign march 2008 into google…

    and got this headline “News results for clinton campaign march 2008” ..

    there was a picture of Barak Obama next to it?

    I am flummoxed.. i really hadn’t expected media bias in google’s search engine.

    maybe i should google google and Obama?

    i went back to check further..

    and the pic next to that entry had changed… to one of barak and hillary.

    is this a general practice? .. rotating pics like that?

    JoB, I’m interested in the Clinton mortgage disclosure bill. Do you have a link? We already have a lot of “Truth in Lending” paperwork that comes with every mortgage. My eyes glaze over reading it. Are lenders leaving something out? What’s new in the Clinton proposal?

    Many news sites use a rotating photo that changes every time you hit it. I guess to keep the page looking fresh.

    Clinton’s bill dealing with the crisis in foreclosure is actually S.2114 : “A bill to amend the Truth in Lending Act, to provide for enhanced disclosures to consumers and enhanced regulation of mortgage brokers, and for other purposes.” Obama also introduced a bill in the face of the mortgage foreclosure crisis: S.1222 : “A bill to stop mortgage transactions which operate to promote fraud, risk, abuse, and under-development, and for other purposes.” Sponsor: Sen Obama, Barack [IL] (introduced 4/25/2007), co-sponsored by Dick Durbin.

    The Library of Congress is a great site to look at all of the bills introduced by each canidate as well as co-sponsors. Kind of interesting to note that many times Clinton was Obama’s co-sponsor and vice versa.

    Not related to politics but rather to the foreclosure crisis.

    Another reality with the constant selling and reselling of mortgage notes is that some of these are being lost. When foreclosure comes some homeowners are getting relief only by the fact that no one can prove who has the mortgage note. No note, then you can’t take my house.

    The Fed has already shown it’s willingness to print more greenbacks out of thin air to prop up the big banks.

    Oregon and Washington actually have pretty good truth in lending laws… I know in Oregon last time i looked the penalty for failing to disclose was an invalid contract… i don’t know what it is here. i don’t think it is quite the same.

    We had a situation like that several years ago when the credit union mtg person and hubby talked me into a variable rate on a house.

    luckily.. i am anal.. because when it reset.. it wasn’t what i thought i had signed.

    we went back to the Oregon credit union for the Washington house we had purchased through the Washington mtg division of the credit union.

    All i had to do was ask for their copy of the disclosure sheet to compare it to mine…

    there was no fraud.. but there had also been no disclosure.

    They couldn’t have helped us into a fixed lower than their current best rate mtg with absolutely no hassle and no fees… any faster.

    Since that is what we wanted.. it was fine. We didn’t choose to get an atty… had we.. it is possible we would have ended up with a free house since we signed in Oregon.

    This is one of the things that has lessened the mtg crisis here…

    people have gotten in over their heads.. but at least they had a heads up when they did it. they gambled that the equity in their home would increase fast enough to allow them to refinance at a good rate later.

    In some cases they were misled by unscrupulous realtor’s about the increased equity they could expect … and since none of that is ever in writing.. they can’t prove it… but at least they could be fairly certain that the mtg they signed had the terms they thought it would.

    Those same laws should be national… because i don’t know what happens when the mtg is signed in one state and held in another. i didn’t pursue it.. but i suspect it becomes murky.

    BTW..

    fraud in a mortgage is when someone signs your name for you where they shouldn’t… or doctors your application to get you financed… or changes the rate without notice and without the stipulation that they can change the rate in your paperwork after you have signed mtg papers…

    why the truth in lending package that hillary was trying to get passed is so important is that it gives homeowners the proof they need in their original loan documents to prove fraud.

    if there is a penalty.. or rate change option.. or anything else that could change the terms of your mortgage.. they have to disclose it… and you have to initial it.

    this is why it is important to go to your closing well rested and actually read everything you initial and ask for an explanation if you don’t understand it.

    WRT the issue of treatment of troops, I suggest everyone troop on over to the troop thread :-) and read the scoop on how we behave toward those we allegedly respect. I suspect most of our soldiers would rather have benefits than have geriatric senators wander around in flak jackets with flag pins on their lapels.

    It’s important enough that I risk a breach of netiquette to crosspost here. I’m hoping the dearth of commentary is because there’s not much to say.

    However, there is an action item WRT Maria Cantwell.

    I really like Timothy Egan…His book “The Good Rain” is fascinating…
