West Seattle (Athletic) Club update: Closure continues

(SATURDAY MORNING UPDATE: Club has yet to reopen)

What appears to be a transition at West Seattle (Athletic) Club continues, with the fitness center closed again today, as announced in e-mail Wednesday and posted on the doors Thursday, both saying it will reopen tomorrow. We went by after a tip that police were called there at midday. No officers there when we arrived, but we did see the truck shown above and exercise equipment sitting outside.

SPD told us the call was about “a disturbance,” but did not lead to arrests. Today was the court-ordered deadline for club owner Sam Adams to pay property owner John Pietromonaco $1.1 million or face eviction; when contacted earlier this week, Pietromonaco told WSB that he had “a plan” if that didn’t happen. We asked the King County Sheriff’s Office if it had or was planning to serve eviction papers; spokesperson Sgt. DB Gates said the “writ of restitution” issued October 6th in the unlawful-detainer (eviction) case has been assigned to a detective, but they don’t comment further on specific plans for serving paperwork (or not).

    It was my understanding per past WSB posts that the equipment was leased to the current owner of the club. Wonder where the leased equipment is going?

    My 86year old father works out there 4 days a week, and I swear its the reason he’s alive. This is VERY upsetting.

    Writs have a 20 day life span, and usually also have a 20 day automatic extension. If a detective has been assigned it is quite likely the writ has been posted and the lockout appointment set out a ways to accommodate the agreement of the parties.
    *
    In cases like this payment of the amount due cancels the lockout, by plaintiff contacting the Sheriff Detective to cancel the lockout appointment. The underlying agreed judgment would be paid and a satisfaction of judgment filed. The Sheriff would return the Writ to the court with a report reflecting the facts.
    *
    If no payment was made, then the Sheriff Detective does a “civil standby” while the owner moves the tenant’s stuff to the edge of the nearest public highway and changes the locks.
    *
    The Sheriff’s eviction information form inquires about such things as dangerous animals, children, and persons who might not be mentally stable.
    *
    If equipment was on the curb, and a Deputy was standing by, you may have been witnessing the lockout.
    *
    If it was a lockout you should be able to go into King County ECR and view the Sheriff’s Return on Writ in a week or so.

    I just walked by the gym again. There was still one truck there and a few workers but nobody seemed to working with any urgency. I could see spin bikes still in the lobby. There were a couple of jugs of what appeared to be cleaning solution haphazardly laying in the parking lot leaking. The pool was nearly drained with various items thrown in it. I will send the blog some pics. I don’t see how it will be open for business tomorrow but I will walk over in the am and check it out. One more thing, all the dumpsters have been removed so there is no where for them to get rid of their trash.

    I have belonged to exactly 6 gyms in 20 years, and 5 of them shut down with no notice, padlock/chained doors, and my funds still being “auto withdrawal” out of my bank account for months. What a racket!!!

    if you are a member, contact your bank, odd are that you will be charged membership still…

    At least remove the lane lines from the pool before it’s drained! I’d be worried about automatic withdrawals from a checking account or credit card if I were a member. If that place is actually open today, I doubt it will be operating at even 50%. Very sad for current members but I am relieved that I quit that gym years ago.

    I’m 73, a member for almost six years. I go to the gym every day Mon-Fri. Healthier and happier because of it! This is a wonderful gym and with proper management can be a money maker for the new owner. Lots of people will join if repairs are made, and if people knew management valued the members. Lots of people will join if the website is kept up-to-date and lots more classes are added and advertised on that up-to-date website! The teachers and staff are marvelous (and incredibly loyal to the members) and I’m hoping they all will be back to work soon — like today. The group classes are just great. To respond to people who criticize our hard working gym staff, I must say: how would you like to work–and have to defend a place–that is so poorly managed that, just for example, the water is turned off by the city! and often promised repairs are not made; where the customers are mad at You because of these management failures?! Horrible! Not their fault! I’m hoping for good news about the re-opening for all of us. I thank the WSB for its efforts in keeping us posted. Please give me good news.

    I just got back from the gym and it is not a pretty sight. Still closed, gym equipment in the lobby, trash strewn about inside and out. Pool drained and lots of people driving up to workout. Sad. We all knew this day would come so let’s hope it opens back up soon. Next week or next month, maybe, but can’t image them opening up this weekend. The place has been trashed.

    This place is done! The building is a lemon, I bet they can tell everyone that they took the word gullible out of the dictionary and everyone will believe it. Why would anyone think this is any different than the other places in Oregon, Tacoma , and bellevue. Stop being willing to give your money to a crook.

    I was just at the Club. The doors are locked and the electricity looks off. The garbage cans are gone.

    The pool is empty except for a small puddle of water in the deep end.

    There are several articles of clothing scattered around in the bottom of the empty pool.

    There are a number of stationary bikes visible in the foyer. The aqua-noodles were also in the foyer.

    The aqua buoys and the pool furniture is still in the pool area.

    It looks to me that it will take a while to transition to reopening.

    I have no further information.

    I’m SO MAD. I just joined again about 2 weeks ago. I asked about the financial health of the place and was told all was good. They charged me annual fee and first and last month fee. It had better open again! Grr.

    I emailed to cancel my membership and was told to fill out a cancellation request in person on Monday. I’m done with that place..with their constantly broken equipment and ownership drama.

    As long as i’ve been going to ALLSTAR ( 10 yr) I’ve been told by maintainence and members that this pool will lift up if the water is All drained. Which was the reason given about why it was never Emptied for any kind of cleaning.

    I hope that wasn’t the reason it was emptied.

    I went by this morning and based upon what I saw; equipment in the lobby, a drained pool with t-shirts strewn about and no activity of people attempting to clean up the club or otherwise make it ready to open, it would appear that reports that the property owner is going to re-open is just collective wishful thinking. Plus, if he was going to re-open, he would be more open with the West Seattle Blog so as to maintain business goodwill. This is a great facility and it is very sad to see it come to an end. If the owner is truly going to re-open, he better speak quickly before people make other arrangements and join other clubs.

    This might be helpful to some folks who have paid for an advance membership. When I was concerned about the future of the club a couple years ago I contacted my credit card company about my options. They said that if the club fails in the next few months that they would give me a refund on a pro-rated basis e.g. if I had used 7 months of a 12 month advance membership they would refund 5 months. So, if you paid for your membership in advance with a credit card you might have some recourse. This, of course, is dependent on what your particular credit card covers. Good luck.

    Was just there; locksmith outside. Was told by a man talking with the locksmith that “Dan” – another man on the premises in a blue jacket- would be taking over management of the space …. That they would try to re-open next week, but that “as for memberships, you’re outta luck because it was a Chapter 11.” What a bummer.

    It is very clear that since the landlord isn’t responding to WSB, that the landlord is probably not trustworthy either. I called my credit card company today to dispute the charge today as this is a fraudulent charge since he charged the monthly fee just two days before he closed the gym and was evicted. I also emailed KIRO TV to see if they can do a story on the “former Seahawk” who takes money from customers without providing the service and employs people and doesn’t pay them. I think others should also reach out to the media as well to get more visibility to this issue to prevent this person from ever opening a new club again. WSB has been outstanding keeping us informed as the gym never kept their customers informed.

    a really honest question. We’ve known for weeks and weeks that money was owed and not being paid, and that there was a court case, and…and…so why in the world would anyone join again? I am not a member, nor have I ever been. But employees are employees, and until the s$&t hits the fan, have to say everything is fine. WSB has reported time and time again about this.

    Go to your banks first thing Monday morning and don’t let this dishonest man take any more of your money. There are other places to work out until LA Fitness opens up.

    Feels like the business AND the property owner have both screwed over the members. Lies about reopening today and lies about “a plan” from the property owners? What’s that plan and WHY has it not been communicated to members??? Why does the HVAC leak all over members in the locker room? Why is the building falling apart with no action from the property owner?
    Complete and utter BS. They’re all crooks in my opinion. This place is DONE.

    Hi, just a heads up, send a written letter of cancellation if you are putting a stop payment on your account. I don’t know if any of you will have the same issue I did with this current situation, but just to be safe. I canceled my membership back before it was West Seattle Athletic Club and my mother’s card was still being charged the monthly membership. I went in twice in person to cancel my membership over a few months and was told it was all taken care of. It wasn’t. Finally back in December of 2013 we sent a written notice and my mother placed a stop payment on her card and the bank agreed with her. They kept trying to charge her card and our bank kept siding with us. We never once received any notice from them or anything about an “outstanding” balance” or that they disagreed with us. I received a collection notice post marked July 25th stating that I had until July 25th to pay the last month membership dues and late charges or my account would be sent to collections. I tired calling several times to get a hold of a manager but the phone was disconnected or the front desk would disconnect. I finally filed a BBB complaint and one with the Attorney Generals office. That’s what finally got them to communicate with me, but I started getting calls from OCI the collection agency and it was hell. My mom and I decided just to pay the principal amount verses fighting it because I didn’t want to get a bad mark on my credit, which I’ve worked hard to keep high. Although I paid, I’m still receiving calls from OCI, thankfully I learned this time to get signed paperwork and kept a receipt hopefully I can get this resolved soon.

    Basically that’s my rant. I’ve never been so disappointed in a business before and it was definitely a learning experience for me as a young adult. It was a sad eye opener that unfortunately you can’t trust a business by their word and you always need things documented. I really hope none of you have to experience this. :(

    Reading Charline’s post above regarding billing (thanks for the detailed info). I”m month to month like most of us and I’m wondering if WSAC can still bill our credit cards with the gym in this legal non-operating position?

    I’d like to stop pmt on the card but don’t want to go through that OCI collection mess. Yikes…

    My billing hits my card on the 7th each month. Don’t recall if it’s the same for all members. Best case is the gym re-opens but like many have stated their has been no communication from the landlord or new owner (if there is one).

      ACG – “Get Jesse” is not working on the air until sometime next year, having changed stations a few months back, but with a non-compete clause in effect.

      Regarding any other TV, weekends are usually short-staffed and while I could be wrong, I expect almost every TV crew in the region to be working a followup to the Snohomish County school shooting. Unless they’re following up on the five-person fatal crash in Auburn overnight. And seriously, we’ve been researching and working this story for more than a year. It’s not easy to just parachute in and have any idea what is going on. They could show up and say “oh, a gym is closed and nobody knows why” but to get any background you’d have to read a year of court documents. Unless you quoted us, or were unethical enough to summarize from our coverage and not attribute. But I digress.

    Hopefully the owner of the building, if he intends to open up for business, is clear in his intent and organized. There is a need for this facility to be open in West Seattle and many of the current customers might well join. Credibility, in light of past events is crucial, and this ongoing silence is not building up credibility.

    My mom has been a member if this gym since it opened. I think back in 2001.
    Always used the auto payment option with a credit card. Recently noticed her card had been charged $130 a month for the past several months. Her rate was supposed to be around $50 a month.
    Every time she went in the gym and asked to speak to a manager about this she was told there was no manager on duty or their computers were down and to try again the next day. Very upsetting.
    So now what happens to members who are enrolled in automatic payments?

    I put a block on my credit card and challenged the charges to my card outside of prorated usage for the ONE WEEK of service I got before being locked out. Amex is investigating. Very irritated to have to go through this. Thanks all for keeping the updates rolling in. Lesson learned about this property owner.

    Thanks for the info Tracy, you have been on top of this story better than any other news service. Jesse did a segment several months ago but I don’t think it aired, it was on their website only and really wasn’t very informative. Like you said, he parachuted in and did a short recap of not much. the WSB’s coverage has been excellent. I was a member for years and when my contract was up I said I would pay month to month cash only and the guy laughed and said is that because of the trouble they have been having and I said yes! I have been a supporter of this club but will not give my CC info to them. They didn’t take me up on my cash only offer. I don’t like the Y (was a member) and am not a fan of big corporate gyms so this one was just my style and super convenient. If this club reopens with q new owner I will consider joining month to month. So many health clubs go under, you just have to be smart about signing contracts. If it doesn’t reopen, I will consider Anytime Fitness.

    I don’t know if the building owner drained the pool but I can’t understand why he would. If this was a Sam Adams’ “I’ve been evicted so screw you” thing on the way out the door, I hope his life is miserable with debt collectors.
    He didn’t pay rent for the last year yet he collected dues each and every month.

    Just stopped by. One of the principles came out to chat. He will be posting tonight. Lots of work to be done but they ( the owners) intend to return the property to first class condition throughout. Deep cleaning, hvac fixed, new equipment including new spin, etc. He will be posting about memberships too. Limited operations in some areas while repairs are done ie pool needs work etc. As you can imagine the previous outfit kinda trashed it and took all they could before midnight. This guy is not new to the fitness arena, and “they are committed to a quality facility”. They intend to honor prior memberships, etc. Stay tuned!

    It was the exact same story and batch of lies when Sam Adams took over. Things will get better, new equipment, etc- that culminated in no rent being paid and an eviction. The place is just broken- better off elsewhere.

    What legal rights do we have to stop payment on our CC for the auto-pay….hard to fill out the form ending your membership if they aren’t ooen…this is sad. It could be such a gold mine if a place if someone took care of it.

    BEWARE: our automatic withdrawal was pulled a day early, on Wednesday. And it included an annual maintenance fee of $30+ dollars! We tried to contest it with our bank, and they got someone from the gym on the phone. The gym rep denied any wrongdoing and said it was all automated. But the bank could see that it had been keyed manually! In the end, the bank couldn’t force them to reverse the charge because we were under contract. So yeah… The gym is closed and I handed over $85 on the eve of destruction. SO mad!!!

    With regards to draining the pool, the thought which immediately comes to mind is liability issues if the pool is full in a building which may be unoccupied for an extended period of time. Plus I suspect it’s been a long time since that pool was cleaned and inspected, draining the pool would facilitate this work.
    Personally I hope who ever is taking over can put the gym back in a secure financial operating position including the pool. One of the reasons I was a member was for the pool and I miss the easy access. The public pools and the Y don’t have lap swim sessions which fit my work schedule so no more swimming for me at this time. I would consider rejoining just for that easy pool access.

    It looks and sounds to me like Adams left with not a small amount of malice. Pool drained – yes, might be liability, but throwing crap INTO the pool – spiteful.

    I suspected this was the endgame from Day One of the Sam Adams takeover. There are always people who want to give the benefit of the doubt, want to trust, and there’s no fault in that. Despite my skepticism, I also hoped I’d be proven wrong. But the writing was seriously on the wall here.

    And I have just as little trust (or less, if that’s possible) in the building owner, who doesn’t know Thing One about running a gym.

    The one positive thing I WILL say, is that I disagree with the “serves you right, you were ripped off” comments – I (mostly) got value for my money. I worked out, I was charged appropriately. Yes, there should have been partial refunds when some facilities were down for months, but on the whole I’m going to spend $50/mo to work out anywhere with a weight rack and treadmills.

    I feel bad for the numerous people who have apparently lost their place to work out as well as membership dues and other fees. Bad deal. Another option would be to look at a local Crossfit gym. I switched about 1.5 years ago and actually saw dramatic real results physically, and the fees are strictly month to month with no maintenance fees and you can leave any time. Low risk high reward.

    I called my bank this morning to make sure west Seattle athletic club can’t charge me anymore, unfortunately they can’t block them from charging my card. My only option is to get a new one. I recommend everyone who was a member do this! I wouldn’t put it past them to continually charge members after they’ve closed. In the meantime, I joined the ymca. It’s a great deal right now and they got an influx of WSC members.

    I have been a die hard member from the beginning. Since then there has been several bankruptcies and numerous changes of management. As well as heaping helpings of excuses, steaming piles of b.s. and broken promises. After hearing from the new gm when I stopped by this morning, for once I feel like we are in good hands and things will finally start to turn around. He also stated earlier, they had to see exactly what kind of damage & mess that was left by the previous jerks to see what their plan of attack will be. We all knew this was coming, we just never knew when. I just hope it opens soon because the new gym in burien is going to open up mid November & I cant wait that long.

    It was Sam who drained the pool, not the landlord.

    The LA in Burien has been pushed back a couple times now, I would not count on that mid November date.

    The other gym in Burien that just took on a new owner is somebody who is just as crooked at Sam Adams, it is now owned that that John Michaels guy, yes the very same one that was a partial owner with Sam until this past winter.

    And Tracy said she had just got contacted by the landlord and would update soon. I do hope they can get people back to work soon since there is a chunk of people out of work right now at the gym.

    You all might consider joining a health club that cares about their members. The YMCA has been around for over 50 years maybe more in West Seattle. Yes, they are more expensive but what you get is a great health club where everyone is welcome, great caring staff, wonderful childcare while you workout and more. The Y in a nonprofit and gives back to our community in West Seattle. They are not going to take your money and run. The Y is here to stay! And yes, the joining fee is waved the month of October. Also I am excited the Y is expanding to make a bigger and better Y for its members and community. I am going on 15 years as a Y member.

    I love, love, the YMCA but seeing this big club close and knowing alot will jump ship over to me makes me a bit worried. It’s a fantastic place but sooo crowded as it is. I love the staff and programs, but for the price and the state of facility as well as space, I have considered changing gyms until they build the new YMCA. My price for my toddler and myself is $90 a month (my husband isn’t a member or it’s another $30 a month)

    I contacted Chase and disputed the monthly charge that was posted the night the gym closed 10/22. Advised the representative that they would likely have plenty of other members calling about this gym to also dispute their charges. Does anyone know if members were charged first AND last month fees when joining? I need to dig out my contract…may be requesting a refund for that too!

    Clay, Unfortunately I signed up 2 weeks ago so can tell you for sure that I was charged an annual maintenance fee plus first month and last month. Don’t know if that is how all members were charged, but was their policy as of this month. Good luck.

    Ah….just put through the chargeback request. Sorry Sam Adams you aren’t getting this month’s money or any more of ours. You can go stuff the shirts you soaked in the pool where the sun don’t shine!!

    This club is clearly closing! Taking my business to Anytime Fitness in WS! Checked out the club, great owner who set me up with a trial and I had my first workout today and loved it.

    My partner and I purchased a family membership on Sept 29th — and paid the full year in advance! We recently moved to Seattle/West Seattle from the East Coast, and had no idea of the financial difficulties. Fortunately, I just spoke to Amex, which I used for the purchase, and they will reverse the charge and conduct an investigation. It may take six to eight weeks to resolve, but he expects that we’ll be reimbursed. So — if you paid with a credit card, take the time to call and ask about your purchase protection. (Meanwhile I too joined for the pool, and will wait for the new owners. I loved the Y in DC, but it’s far too crowded if you are a serious swimmer.)

    Saddens me to see so many folks taken advantage of but you should know that it doesn’t matter what the contract says. When you authorized the funds, you specifically authorized it for a service that was specific and not provided to you, which is technically fraud. Even if you signed the contract. The bottom line is that the service was not rendered, which is credit card fraud in addition to breach of contract (rendering the contract void). You should use that terminology when speaking with credit card folks. Good luck getting your money back.
