pedestrians only have right of way if in a cross walk and you can prove it

    Hello my name is Kelsie D. Clemens-Campbell I'm a young 21 year old girl. On 10/26/11 around 8:30pm I was in a horrible incident on 35th & Avalon where I was a pedestrian crossing the street and was hit by a car making a left and I was walking crossing the street by the KFC returning to my home. I was rushed to the emergency room where I had x-rays done and was prescribed all sorts of pain killers and muscle relaxers, I'm still in all sorts of horrible pain and walk with a limp although none of my bones were broken, but recently I discovered ny spin is bent in 3 different places, and my neck is bent the wrong way due to the accident. I'm trying to further investigate my case for being hit but unfortunately only have witnesses that talked with the police that were not in my favor and said I wasnt in the cross walk but j walking, which I believe some witnesses were left out like the other people in that same crosswalk going the opposite direction as me. As well as needing any camera recordings pointing in the direction where I was hit in order for a lawyer to help me. Please I need help finding the other pedestrians and other witnesses who remember that day I got hit, so I can have them further help my case. If I can get any help I'd be very greatful. Please I need justice for my accident! No lawyer will help me because apparently I don't have the right of way as a pedestrian. I've contacted the city for stop light camera recordings and they say they can't help me. Where is my justice?????

    Also I was in the cross walk but its too faded to tell if there even is one especially if your in a car which were my witnesses and the person who hit me

  3. so, were you ticketed for jaywalking? how far outside of the crosswalk did they say you were? I guess I would ask to put an X on the ground where you were hit, and then have them measure. If you have to go to court over this, can they prove you were outside of the crosswalk?

    I didn't recieve a ticket for Jaywalking nor the driver a ticket for hitting me. The car didn't instantly stop when he hit me so I was dragged from the crosswalk, and I was almost finish crossing, but I did take pictures of I was before being hit and the crosswalk is faded there so there really is no way the witnesse nor drive can tell if I was or wasnt in the walk

    One person said I was 20feet away from the crosswalk but was walking along side it,

    Kelsie: It is impossible to tell from your posts what it is that actually happened, other than that you apparently were hit by a car and injured. I also cannot believe "no lawyer" will help you because of some issue about the right of way. What I do know is that you should try much harder to find a lawyer if you hope to recover any money to compensate you for your injuries. Try the Washington Association for Justice, at http://www.washingtonjustice.org. It is a statewide association of lawyers who represent people who want to pursue a legal claim against someone who they believe is responsible for their injuries. If that doesn't work, start looking on websites like Avvo for lawyers who represent plaintiffs and accident victims. The forum is not going to be able to deliver you the the "justice" you are looking for.

    Thank you, I'm sorry my message is a little jumbled up. I was trying to input what happened from my view as well as what witnesses were claiming guess I should try re-writing this a little better.
