Followup: 3 West Seattle dispensary-robbery suspects in court

Two days after an armed robbery at a medical-marijuana dispensary in the 5400 block of California SW (original Saturday night WSB coverage here), the three suspects made initial court appearances this afternoon. The King County Prosecuting Attorney’s Office says the adult suspect, 24, has bail set at $500,000; the 15- and 16-year-old boys who also were arrested have been ordered to “remain in secure detention.” The KCPAO has until Wednesday to file charges or set the suspects free. We’ll add to this story shortly with details from the court documents accompanying word of today’s hearing.

On Saturday, 3-19-11, at approximately 1800 hrs, suspects (juvenile 1), (juvenile 2) and (adult) entered the Game Medical Marijuana Dispensary, located at 5437 California Avenue SW in the City of Seattle with the intent of committing an armed robbery. Upon entering the facility, suspects (juvenile 1) and (adult) pulled out semi-automatic pistols, taking aim at two dispensary employees and three customers.

The victims were forced to the floor at gunpoint and subsequently had their hands tied with zipties. (Juvenile 1) went behind the counter and removed the cash from the cash register while suspects (Juvenile 2) and (adult) robbed the victims of their wallets, cellular telephones, vehicle keys as well as removing the medical marijuana from the shelves and storage cabinets. (All three suspects) ran from the dispensary. It should be noted that (witness…) who has (a business nearby) heard the armed robbery taking place and set off an audible alarm and telephoned 911 and reported this incident. Seattle Police Department (SPD) uniformed officers were being dispatched during the robbery.

Victims (three names) managed to get their zipties off their hands and exited the dispensary. Once outside, they observed the three suspects running south from the scene. Suspects (juveniles) ran (bound?) on California Avenue SW in the 5400 block while suspect (adult) ran south in the alley to the west of California Avenue SW. (Two victims) followed (juvenile suspects) in (victim’s) pickup truck while (victim) followed suspect (adult) in his vehicle. (Victims) flagged down the responding officers and pointed out (juvenile suspects), who were subsequently taken into custody.

(Victim), while driving southbound in the alley to the west of California Avenue SW, observed some of the bags of Medical Marijuana and a loaded semi-automatic pistol on the ground. (Victim) stopped his vehicle and began to pick up the Medical Marijuana and place it into his vehicle. As (Victim) was collecting the stolen property, he observed suspect (adult) running northbound in the alley directly at him. It was apparent to (victim) that (adult suspect) was returning to collect the stolen Medical Marijuana and the semi-automatic pistol that he had discarded. (Suspect), fearing for his safety, picked up the semi-automatic pistol that was on the ground and took aim at (adult suspect) who was now approximately ten feet from him. (Victim) ordered (suspect) to the ground. (Adult suspect) complied with (victim’s) orders and laid down on the ground. (Victim) sat on (adult suspect) until SPD Officers arrived.

(Juvenile suspect), post-Miranda, confessed to being armed with a .22 caliber pistol and removing the cash from the cash register. More …

According to the probable-cause document, the adult suspect is from Northgate, the two teenagers from Des Moines. The adult has an assault conviction (we researched that earlier – it involves an attack on a Metro bus driver near Shoreline Community College almost two years ago); the 15-year-old suspect has a record described as “dangerous weapon” and “assault”; there is nothing listed for the 16-year-old.

    I hope they prosecute the juveniles as adults so they can keep them locked up for awhile.

    I surely don’t want gun wielding 15 and 16 year old robbers on the street anytime soon.

    Wow. That took some nerve on the part of the victim. I’m glad that worked out as well as it did. That suspect complied because he *knew* the gun was loaded.

    I can only hope the juveniles receive something from The System that lets them know how serious this all was.

    Good on Seattle P.D. for responding so quickly, good on the witnesses for calling it in, good on the “victims” for helping them catch the bad guys.

    Each successful crime only emboldens these thugs- if they failed every single time they wouldn’t bother doing it anymore and the world would be a better place. So I like aggressive “victims” and the proper use of guns (ie, by the “victim” instead of the thug).

    Here’s hoping the cops didn’t end up “stealing” the weed for their evidence room- that stuff should be legalized like tobacco already. *sheesh*

    Ditto on good coverage, WSB! Hope the perps are dealt with fairly and firmly. Use of a gun and strong arm robbery = very severe consequences. As for bad guys going after illegal business activity – well, birds of a feather…. maybe these entrepreneurs will think twice before they reopen their enterprise.

    Ditto Mike. Game is a licensed business in Seattle and doing no illegal activity so furor scribendi must be on some narcotic type drugs to post a comment like that. Entrepreneurs are what keeps this country going! I am glad to hear that the real criminals are in jail where they should be and that Game is open to serve their patients without skipping a beat.

    Defensive often, C-bug? Perhaps you should look outside the box, or the cloud, to see the fate of similar ‘businesses’ whose business licenses couldn’t forstall closure, sanction, and other penalties. See what they’re doing in Federal Way, Tacoma, Los Angeles and elsewhere to shut down dispensaries….. and hopefuly here, soon.

    Regardless of what they sell, why can’t the victim “business” play by the same business license rules as the rest of us? Why can’t they pay B&O taxes like the rest of us? Why can’t they pay income taxes like the rest of us?

    A. No person, unless specifically exempted, shall engage in any business activity, profession, trade or occupation in the City without having first obtained and being the holder of a valid and subsisting license to do so, to be known as a “business license.”

    Under SMC 5.55.220 This is a gross misdemeanor (up to 1 year in jail).

    It also has no state license as G.A.M.E. Collective https://fortress.wa.gov/dol/dolprod/bpdLicenseQuery/

    It is also a crime not to pay Business and Occupation tax.

    Nothing in RCW 69.51A which permits possession of marijuana for medical purposes exempts G.A.M.E. Collective from otherwise being a tax paying business in a commercial district in our neighborhood.

    The next criminal charge needs to be issued to the tax evaders operating this illegal business.

    The state determines when and from whom we can buy alcohol and at what tax rate — they should do the same for marijuana.

    Not sure where anyone sees a business license for GAME Collective in West or North Seattle with the city or the state.

    Regardless of what they sell, the business should play by the same business rules and laws as the rest of us – pay B&O taxes-sales/use taxes-city license fees-master business license fees-like the rest of us. Looks like a free for all from what I can find.

      tax and license free – I had been researching all this for a story even before the Delridge controversy came up and then the Saturday robbery. 5437 California SW is licensed as Green Piece Alternative Medicine and Educational Clinic. GAME is a partial acronym. Although now that you point it out, their license is listed as through 12/31/2010, and we’re a couple months past that.
